Terms of Service for LSC.training

By creating an account on LSC.training or using any part of our services, you, the "User," acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Lincoln Square Coaching LLC.

LSC.training grants, and the User hereby accepts, a non-exclusive, non-transferable, revocable license to use the data and documentation contained in the online courses on the terms and conditions set forth in this Agreement. This license is for individual use only and does not constitute a sale.

4.2. Upon registration and payment of applicable fees, users receive access to and are granted use of the course materials ("Courses") and exams.

4.3. Information received through LSC.training is to be used solely for individual purposes. None of the content may be reproduced, transcribed, stored in a retrieval system, translated into any language, retransmitted in any form, resold, or redistributed without the prior written consent of Lincoln Square Coaching LLC, except that the User may reproduce limited excerpts for personal use only, provided that each such copy contains a copyright notice as follows:

4.4. Without prior written consent, you may only print, download, or otherwise use the Content in the form of: (i) one machine-readable copy; (ii) one backup copy; and (iii) one print copy, for your non-commercial use.

4.5. You shall not delete any proprietary notices or materials with regard to the foregoing manifestations of the Content.

5.1. You agree to use LSC.training for lawful purposes only and in a way that does not infringe upon or violate the rights of any other person.

5.2. You will not:

- Use the platform in any way that could disable, overburden, or impair the site or interfere with any other party's use of the platform. - Attempt to gain unauthorized access to any part of the platform, other user accounts, or computer systems or networks connected to LSC.training. - Use any robot, spider, or other automatic device or manual process to monitor or copy any content from the platform. - Introduce any viruses, trojans, worms, logic bombs, or other malicious or technologically harmful material.

6.1. Fees for courses or services are as quoted on LSC.training. We reserve the right to change fees at any time.

6.2. All payments are processed securely through our designated payment processors.

6.3. Refund Policy:

6.3.1. Eligibility: Users are eligible for a full refund of any paid course fees within 14 calendar days of the original purchase date, provided that the user has not completed more than 20% of the training content.

6.3.2. Completion Rate Calculation: The completion rate is based on data tracked by our learning platform, which monitors course progression. This includes, but is not limited to, pages viewed, videos watched, quizzes taken, and any other measurable interactions within the course.

6.3.3. Refund Process: To request a refund, users must contact us at [email protected] within the 14-day period. Upon receiving the request, we will review the user's course progression data to verify eligibility.

6.3.4. Approval and Processing: If the refund request is approved, we will process the refund to the original payment method within 10 business days of the approval.

6.3.5. Denied Refunds: Refund requests will be denied if:

- The request is made more than 14 calendar days after the purchase date. - The user has completed more than 20% of the course content, as determined by our learning platform's tracking data. - The user has downloaded certificates of completion or other course materials that cannot be revoked or returned.

6.3.6. Exceptional Circumstances: In cases of technical issues or extenuating circumstances that prevent course access or completion, users may contact us for review on a case-by-case basis.

6.3.7. Course Access After Refund: Upon issuing a refund, LSC.training reserves the right to revoke access to the course content.

6.4. We reserve the right to modify this refund policy at any time. Any changes will be effective immediately upon posting the updated policy on LSC.training.

LSC.training and its content are provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied. We do not warrant that the platform will be uninterrupted, timely, secure, or error-free.

To the fullest extent permitted by applicable law, Lincoln Square Coaching LLC and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the platform.

You agree to defend, indemnify, and hold harmless Lincoln Square Coaching LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the platform.

We reserve the right to terminate or suspend your account and access to LSC.training immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

This Agreement is to be governed and construed in accordance with the internal laws of the State of New York, without regard for principles of conflicts of laws. Any civil action, claim, dispute or proceeding arising out of or relating to this Agreement, except for an injunctive action regarding a breach or threatened breach of any provision of this Agreement by you, shall be referred to final and binding arbitration, before a single arbitrator, under the commercial arbitration rules of the American Arbitration Association in New York.
